IMPORTANT NOTICE
We’re excited to have you (or your child) training with us! Please read and sign below to get started.
1. RISK & RESPONSIBILITY (READ THIS)
Martial arts, self-defense, fitness training, sparring, partner drills, and using equipment involve real risks (including serious injury, disability, or death). By signing, I agree that:
- I’m choosing to participate (or letting my child participate) and I accept the risks, including risks from contact with other students, falls, submissions/joint locks, strikes (where applicable), and training accidents;
- Health check: I (and/or my child) am healthy enough to train, will train safely, and will tell the Academy about any injury/condition that could affect safe participation;
- No medical supervision: Instructors are not doctors and the Academy does not provide medical supervision;
- Release (Ontario): To the fullest extent allowed by Ontario law, I release and forever discharge Vanguard Self-Defense Academy, its owners, instructors, coaches, staff, volunteers, agents, and landlords (the “Released Parties”) from any and all claims, demands, actions, or causes of action for injury, loss, or damage that I (or my child) may suffer arising from or related to participation, including negligence, except to the extent the loss is caused by the Released Parties’ gross negligence or willful misconduct;
- Hold harmless / no lawsuits: I agree not to sue the Released Parties for matters covered by this release; and
- Indemnity: If I (or someone on my/our behalf) makes a claim against the Released Parties that is covered by this release, I will indemnify and hold the Released Parties harmless from related losses, costs, and legal fees (to the extent permitted by Ontario law).
5. MEDICAL HELP
If an injury occurs, you authorize our staff to seek medical care for you (or your child) if needed. Any medical costs will be your responsibility.
6. MEDIA RELEASE
We love sharing our students' progress! You give us permission to use photos or videos taken during class of you (or your child) for our website or social media.
7. MEMBERSHIP RULES
- Memberships run for 12 months with monthly payments (unless otherwise agreed in writing).
- To cancel auto-billing, we need 30 days’ written notice (email is fine).
- We may update Academy policies from time to time, and we’ll let you know if there are material changes.
8. FACILITY RULES AND CODE OF CONDUCT
I agree to abide by all Academy rules, policies, and codes of conduct, including:
- Following all safety instructions provided by instructors;
- Using equipment properly and as instructed;
- Wearing appropriate training attire and protective equipment as required;
- Maintaining personal hygiene and cleanliness;
- Treating instructors, staff, and fellow members with respect and courtesy;
- Refraining from aggressive, violent, or inappropriate behavior outside of supervised training;
- Notifying instructors of any injuries before, during, or after training;
- Supervising minor children at all times when not actively participating in class; and
- Respecting the Academy's property and the personal property of others.
The Academy reserves the right to update or modify facility rules at any time. Members will be notified of material changes.
9. INSURANCE ACKNOWLEDGMENT
I acknowledge that:
- The Academy does not provide accident, health, or disability insurance for participants;
- In Ontario, OHIP may cover some medical care if I (or my child) gets injured, but the Academy does not provide personal insurance for extra costs like physiotherapy, chiropractic care, dental work, medications, braces/orthotics, or lost wages;
- I (or I as the parent/guardian) am responsible for any costs not covered by OHIP or my own insurance;
- I am responsible for obtaining and maintaining adequate personal insurance coverage;
- I have been advised to consult with my insurance provider regarding coverage for martial arts activities; and
- The Academy is not responsible for reviewing or verifying the adequacy of my insurance coverage.
10. PERSONAL PROPERTY
I acknowledge that:
- The Academy is not responsible for the loss, theft, or damage to personal property brought onto the premises;
- I am solely responsible for safeguarding my personal belongings;
- The Academy does not provide secure storage and any lockers or storage areas are provided as a convenience only; and
- I release the Academy from all liability related to personal property loss or damage.
11. SEVERABILITY
If any part of this agreement is found unenforceable, the rest still applies. The invalid part will be adjusted only as much as needed to make it enforceable while keeping the original intent.
12. ENTIRE AGREEMENT
This is the full agreement about these topics and replaces any prior discussions or promises. Any changes must be in writing.
13. GOVERNING LAW
Ontario law applies to this agreement.
14. ACKNOWLEDGMENT
By signing, I confirm that:
- I read and understand this agreement and I’m giving up certain legal rights (including the right to sue);
- I’m signing voluntarily and had the chance to ask questions and get legal advice if I wanted;
- If I’m signing for a minor, I’m that minor’s parent/guardian (or otherwise authorized) and I agree this binds the minor and me; and
- This agreement applies for as long as I (or my child) participates and it continues to apply even after membership ends.
